Individual seminars last from sixty to ninety minutes, and some topics can be combined for significant cost savings. Each presentation is conducted by two experienced Walter & Haverfield employment lawyers, with maximum participation by all attendees highly encouraged. No question is too simple or too complex, and each will be addressed by seminar leaders. ___HOW TO REMAIN A UNION-FREE WORKPLACE
The decline in union representation has made unions, if anything, more aggressive in pursuing remaining targets of opportunity. The best defense against an organizing campaign is to create the kind of employee-friendly workplace that stymies union activity – and to respond promptly to early probes before they turn into major organizing campaigns.
Time: 90 minutes.
___COMBATING A UNION ORGANIZING CAMPAIGN
From company management to first-line supervisors, the law spells out what can and can’t be done to combat a union organizing campaign once it’s underway. This presentation explains how to fight and win – without running afoul of the NLRB or courts.

___INVESTIGATING AND ARBITRATING LABOR GRIEVANCES
Designed for employers who are already unionized, this seminar focuses on the entire grievance process – helping HR professionals respond to the initial filing of a grievance, investigate it effectively, resolve it if at all possible, and effectively arbitrate the complaint when voluntary resolution is impossible. Guidance also is provided on arbitration techniques that can reduce preparation time and minimize legal fees.

___AVOIDING WORKPLACE PRIVACY AND DEFAMATION CLAIMS
It’s amazingly easy to violate the privacy of past, present or prospective employees – and to disparage them to others. Managers do it all the time, and their companies get sued as a result. This presentation provides a clear path through the minefields.

___ENFORCING SEXUAL HARASSMENT POLICIES
This seminar reviews what constitutes sexual harassment in the workplace and how to prevent it – from the effective communication of a sexual harassment policy, through the prompt and private investigation of a complaint, to its appropriate resolution. With four generations of employees in today’s workplace, it’s easy to understand how gender issues can be viewed differently through different eyes.

___DISCIPLINING AND DISCHARGING “BAD ACTORS”
Problem employees poison the workplace environment. With careful planning and full awareness of the law, managers can plot a course to document the problem, discuss it with the employee, take appropriate disciplinary action if the problem continues, and terminate the individual if resolution fails – all the while avoiding claims of discrimination or wrongful discharge,

___UNDERSTANDING FMLA
The Family and Medical Leave Act is arguably the most nuance-ridden area of employment law. This seminar reviews employers’ basic obligations and rights under FMLA and how this federal law interacts with the Americans with Disabilities Act and workers’ compensation laws. It also provides practical guidance on processing FMLA requests and resolving leave-related issues.

___RESPONDING TO ENFORCEMENT AGENCIES
This presentation is especially designed for employers who draft their own responses to enforcement-agency complaints. By learning how to prepare better-written, more thoroughly prepared position statements, employers can enhance their chances of prevailing in litigation and avoid the embarrassment of submitting poorly worded documents that are later used against them.
