The Irish Legal 100, a compilation of the most distinguished U.S. legal professionals with Irish roots, has named Kevin Patrick Murphy and John N. Neal to its 2021 edition. The list includes attorneys, legal scholars and members of the judiciary who have distinguished themselves in their fields of endeavor.

Kevin, administrative partner of Walter | Haverfield as well as a partner in the firm’s Business Services Group, represents public and private companies on major real estate transactions that include construction, development, financing, leasing, acquisitions, dispositions, exchanges, zoning, and entitlements. Kevin’s practice also focuses on negotiating acquisitions, dispositions, buyouts, and joint ventures. He advises clients on structuring transactions and corporate governance matters. Furthermore, Kevin represents marijuana business owners, individuals looking to enter the legal cannabis industry, and those looking to effect change in marijuana laws and regulations.

Kevin is an Irish citizen with an Irish passport. He is the second generation in the U.S., and his family is from County Roscommon. Kevin is currently a member of both the East Side Irish American Club and the Irish American Law Society of Cleveland. John, partner and head of the Hospitality and Liquor Control Group, focuses his practice on Ohio state and federal liquor permit licensing, and the licensing of Ohio’s new medical marijuana industry. At the same time, John has developed a diverse set of legal skills with complex commercial litigation, employment law, business organizations, insurance coverage, real estate, and business transactions. As such, he has been retained as outside general counsel by companies who need same-day answers on a variety of issues.

Walter | Haverfield partner Tim Jochim, who is a national authority on business succession and ESOPs, is joining the inaugural Public Policy Council of The ESOP Association. The ESOP Association is the largest employee ownership advocacy organization in the world and represents the interests of millions of employee owners and their companies nationwide.

During his two-year term, Jochim and the other appointed council members will help shape and guide the public policy initiatives and advocacy activities of The ESOP Association.

Second Walter | Haverfield Partner Selected for Magistrate Judge

Former Walter | Haverfield litigation partner, Darrell A. Clay, is the newest Magistrate Judge for the Northern District of Ohio federal court. Clay is succeeding James R. Knepp II, who was recently elevated to serve as a district judge, and he will be based at U.S. Courthouse in Toledo.

Clay follows former Walter | Haverfield attorney, Jonathan D. Greenberg, who also became a magistrate judge for the U.S. District Court for the Northern District of Ohio in 2016.

“Although it’s a bittersweet goodbye, we are extremely proud to see Darrell selected as a magistrate judge,” said Ralph Cascarilla, managing partner of Walter | Haverfield. “He is an experienced litigator, and has all the capabilities and sound moral standing needed to become highly esteemed and successful in his new positon.”

For 24 years, Clay has focused his practice on labor and employment, litigation and white collar criminal defense at Walter | Haverfield. With substantial experience before federal courts, state courts, and administrative tribunals around the country, he regularly handles civil and white collar criminal disputes for individuals, business entities and governmental bodies. His last day at the firm was May 3, 2021.

“Walter | Haverfield is a unique law firm full of special people,” said Clay, who served as president of the Cleveland Metropolitan Bar Association in 2017-2018. “It was a privilege to work there for more than two decades, and I’ll greatly miss my colleagues and valued clients.”

Clay said his seven years as a member of the Ohio Supreme Court’s Board of Commissioners on Character and Fitness, including the last three as its Chair, is what initially piqued his interest in jumping to the other side of legal decision-making and becoming a magistrate judge.

“This feels like the right time for me to transition into this role,” Clay said. “I am thrilled to have the opportunity to parlay my experience as a courtroom advocate into deciding cases, as opposed to arguing them.”

Selection as a magistrate judge is the culmination of a multi-stage process involving a lengthy written application, an interview by a panel of attorneys from throughout the Northern District of Ohio, and ultimately a final interview by all current judges of the Northern District. Full-time magistrate judges serve for renewable terms of eight years.

Clay will have broad and varied responsibilities as a magistrate judge. These include presiding over preliminary proceedings in criminal cases, conducting pretrial matters and evidentiary proceedings on referral from district judges, and overseeing trial and disposition of civil cases upon consent of the litigants.

An instrument-rated commercial pilot and aircraft owner, Clay will continue serving as President-Elect of the Lawyer-Pilots Bar Association. In August 2021, he will be sworn-in as President of that group, the largest specialty bar association focused on the unique legal issues at play in the aviation industry.

“I am looking forward to conquering a new level of problem-solving,” said Clay. “My time and experience at Walter | Haverfield has prepared me for the next phase of my legal career, and I’m ready get started on this exciting journey.”

Walter | Haverfield attorneys, Doug Eppler, Miriam Pearlmutter, Max Rieker and Greg Watkins, have been elected as the firm’s newest partners. The four additions bring the firm’s partnership to 55 members.

“I am proud to have Doug, Miriam, Max and Greg join our partnership,” said Ralph Cascarilla, Walter | Haverfield’s Managing Partner. “They each work diligently to bring a unique set of skills that benefit our clients.”

Eppler is a member of Walter | Haverfield’s Litigation Services group, with a focus on creditors’ rights enforcement, commercial litigation, and trust and estate litigation. He regularly represents commercial lenders in creditors’ rights and bankruptcy litigation. In addition, he represents clients in business litigation arising in a variety of contexts. His trust and estate litigation experience includes active participation in all phases of these cases, including during bench and jury trials.

Pearlmutter’s practice focuses on school law, including special education, labor and employment issues, and bullying/harassment complaints. Among other matters, she advises clients on issues of employment discrimination, student discipline, disability accommodations, constitutional rights, policy drafting and implementation, and public records requests. Miriam also assists school boards with all aspects of the special education process, including training staff, attending ETR and IEP meetings, and reviewing documents for compliance. Miriam represents her clients in state and federal courts, at both trial and appellate levels, as well as before the Office for Civil Rights, the Equal Employment Opportunity Commission, and the Ohio Department of Education.

Rieker is an Ohio State Bar Association certified specialist in labor and employment law. Max counsels both private and public sector employers in a full range of workplace matters. Max has successfully represented clients before a variety of arbitrators, boards, commissions, administrative agencies and courts throughout Ohio. He has extensive experience handling administrative investigations, employee discipline and police use-of-force cases. Having negotiated well over 100 public sector collective bargaining agreements, Max also has the skills to craft solutions for public entities. He has represented clients in dozens of cases through the statutory fact-finding and conciliation process. Max’s practice also focuses on the needs of private sector clients, having represented small businesses, mid-size manufacturers and significant international corporations.

Watkins’s practice concentrates on corporate and business law. He represents buy-side and sell-side clients in mergers and acquisitions. In addition, he counsels clients on general corporate and business matters, including governance, compliance, and day-to-day operations. He assists entrepreneurs and growing businesses in navigating the business formation process and the ongoing requirements of business management, particularly with entity selection and structure, formation, organization, and exit strategies. Also, he advises start-ups and early stage companies on capital raising and compliance with federal and state securities laws.

Ohio Super Lawyers Selects Nearly 20 Percent of Walter | Haverfield Attorneys

Ohio Super Lawyers, a prominent legal rating service that recognizes outstanding lawyers for their high degree of peer recognition and professional achievement, has selected twelve Walter | Haverfield attorneys to its 2021 Ohio Super Lawyers list. It has also selected an additional six attorneys to its Ohio Rising Stars list, which honors candidates who are either 40 years old or younger or have been in practice for 10 years or less. The names of those honored are below.

Each year, no more than five percent of lawyers in the state are selected by the research team at Ohio Super Lawyers to receive recognition, and no more than 2.5 percent of lawyers in the state are recognized by the Ohio Rising Stars research team.

The Supreme Court of Ohio has reappointed Darrell A. Clay, partner at Walter | Haverfield, to chair the state’s Board of Commissioners on Character and Fitness. Clay, who has served on the Board since 2015, will serve as chair for his third term.

The Board of Commissioners on Character and Fitness is responsible for ensuring that each applicant for admission to the practice of law in Ohio possesses the requisite character, fitness, and moral qualifications for admission. The Board consists of 12 members, appointed by the Court, who must be members of the Ohio bar. Clay will serve as the appointee for the Sixth Appellate District of Ohio based on his residency in Ottawa County.

As Board Chair through Dec. 31, 2021, Clay will work closely with the Bar Admissions Office staff on issues that arise between the Board’s bi-annual meetings. At those meetings, he will preside over the presentation of reports from hearing panels and the Board’s subsequent deliberations and issuance of recommendations.

Clay focuses his practice on labor and employment, litigation and white collar criminal defense. With substantial experience before federal courts, state courts, and administrative tribunals around the country, he regularly handles civil and white collar criminal disputes for individuals, business entities and governmental bodies. In 2017-2018, Clay served as president of the Cleveland Metropolitan Bar Association, the largest metropolitan bar association in Ohio. He is President-elect of the Lawyer-Pilots Bar Association, and will serve as its President in 2021-2022.

Walter | Haverfield Represents Local Developer to Acquire Former Geauga Lake Land

The former home of Geauga Lake Park, Six Flags and Sea World in Bainbridge Township, Ohio will be developed into residential and commercial use, thanks to Industrial Commercial Properties (ICP) of Solon. ICP bought a 377-acre portion of the former amusement park site and gained the rights to develop it with assistance from a team of attorneys at Walter | Haverfield.

Walter | Haverfield represented ICP in the purchase and financing of the land, as well as related development matters, together with the simultaneous sale of a portion of the land to Menards for planned construction of a Menards retail location.

“We worked extremely hard to ensure ICP got the desired outcome in acquiring this highly-sought-after property that has such rich history,” said Ed Hurtuk, Partner-in-Charge of Walter | Haverfield’s Mayfield Heights office. “We’re eager to see how the project continues to evolve and are looking forward to our ongoing representation of the mixed-use developer.”

Hurtuk’s team included Walter | Haverfield real estate attorneys Josh Hurtuk, Andy Gardner, Alex Hurtuk, Haley Eppler, Sydney Benson, Mitchell Kolesar as well as Sean Mellino, a partner in the firm’s Intellectual Property Group. It also included Karen Remley, paralegal, and Sue Speck, legal assistant. The group began the project in late summer 2019.

Geauga Lake is fondly remembered by Northeast Ohioans for its rollercoasters, rides and water slides. In its new role as master developer, ICP plans to reintroduce components to the site that pay homage to the prior tenant and theme park, which was established in 1887.

“We are a family here in Greater Cleveland,” said Chris Semarjian, owner of ICP. “We want the property to be something great and leave a legacy. Geauga Lake is a fairly large body of water, a spring-fed lake. There have not been too many developments like this in our market.”

The site will be developed into a residential, commercial and entertainment district. ICP expects that retail space and a cluster of homes will be completed in 2022, as construction on the land began this fall.

Benjamin Carnahan Joins Walter | Haverfield

Ben Carnahan, who focuses his practice on business services and litigation, has joined Walter | Haverfield as a partner in its Cleveland office.

“I am thrilled to join a full-service firm with deep bench strength that is focused on providing personalized service to its clients,” said Carnahan who most recently worked at a mid-size Midwest law firm. “The depth and breadth that Walter | Haverfield offers will be a substantial benefit to my current clients.”

Carnahan represents companies big and small, from the nation’s largest banks, lenders and loan servicers to small businesses and closely held corporations, often serving as outside regional counsel managing litigation in multiple states/jurisdictions for his clients.

Carnahan currently serves as a board member and treasurer of Taleris Credit Union in Northeast Ohio. The positions have allowed him to gain a better understanding of the business side of banking, which is also advantageous to his financial institution clients.

In his personal time, he enjoys hiking with his yellow lab, painting, boating, and water/snow skiing with his wife and two children.
