ODE Proposes Rule Changes and Calls for Comments

The Ohio Department of Education has posted a variety of proposed changes to the Operating Standards, and is soliciting comments on those proposed changes through July 31, 2020.  While everyone’s focus is understandably the safe reopening of schools this fall, we encourage everyone to spend time reviewing the proposed changes and to submit comments.  We specifically urge review of the proposed changes to 3301-51-05 in relation to allowing a change in placement without parental consent and the submission of comments in support of this change.  This change would bring Ohio into alignment with Federal law and most other states, and is vitally important in the ability of districts to provide FAPE to students in the most appropriate LRE.  If you have questions relating to the proposed changes, the impact of those proposed changes, or how to submit comments, we encourage you to reach out to your legal counsel.
