Overview

Aimee is a partner with Walter | Haverfield LLP and is a member of the firm's Municipal Law, Public Law and Education Law practice groups. She currently serves as the law director for the village of Moreland Hills and the assistant city solicitor for the city of Hudson. Aimee has considerable experience representing public entities, including cities, villages, townships, school boards and districts in the areas of land use, planning and zoning, code enforcement, storm water management (including U.S. EPA and Ohio EPA mandates), municipal litigation, public improvement projects, nuisance abatement, eminent domain, records retention, Ohio's Sunshine Laws, and election issues.

Prior to joining the firm, Aimee gained municipal law experience through her work in a thriving outer ring suburb dealing with the issues of rapid residential and commercial development, including planning and zoning concerns, storm water management, code enforcement, codified ordinance revisions, administrative appeals and municipal litigation. Aimee also worked with a smaller community committed to the redevelopment of its aging buildings and infrastructure as well as the preservation of its limited green space.

Planning & Zoning
  • Works with planning consultant to rewrite city planning and zoning code.
  • Amends codified ordinances for municipal clients to comply with U.S. EPA and Ohio EPA storm water management requirements.
  • Attends monthly planning commission and board of zoning appeals meetings and advise commissions/boards on legal issues.
  • Regularly reviews and advises municipal clients on issues regarding code interpretations, land use and zoning applications and procedural issues.
  • Regularly represents municipal clients in appeals of code enforcement officer's interpretation of code or violation notice before local zoning board and, subsequently, in common pleas court.
  • Represented property owner before township zoning board regarding proposed telecommunications tower in residential district.
  • Represented property owner before city planning commission seeking code amendment regarding nonconforming use provisions.
General Municipal
  • Attends to day-to-day issues faced by municipalities in a general counsel role.
  • Regularly responds to public records requests.
  • Regularly advises clients on Ohio Open Meeting Law.
  • Regularly advises clients on Ohio Ethics Law.
  • Drafts legislation for monthly council meetings and reviews and comments on agreements or other materials and information pertaining thereto.
Municipal Litigation

State Court

  • Represents municipal clients in R.C. 2506 administrative appeals regarding land use and planning decisions rendered by planning commissions, boards of zoning appeals and councils at all levels - trial court, court of appeals and Ohio Supreme Court.
  • Represented city in 2506 appeal filed by abutting property owner regarding zoning board's decision to grant variances for additions to school building.
  • Represented city in 2506 appeal filed by developer of planning commission's denial of subdivision.
  • Represented township in 2506 appeal filed by developer regarding planning and zoning commission's approval of subdivision with fewer lots than requested (including constitutional claims).
  • Represented village in 2506 appeal filed by group of residents regarding planning commission's approval of conditional use permit to permit a place of worship to be located in residential district.
  • Represented city in 2506 appeal filed by developer of zoning board's denial of variances which would have permitted new homes to be built in closer proximity to gas well head and tank battery than permitted by code (including constitutional claims).
  • Represented city in 2506 appeal filed by neighbors regarding zoning board's approval of variances for expansion of church in residential district.
  • Represented village in 2506 appeal filed by property owner of village zoning board's decision upholding building inspector's denial of building permit and denying variances to build mini-self-storage facility (including declaratory judgment claim to declare zoning ordinance unconstitutional).
  • Represented city in taxpayer action for injunctive relief regarding decision of city zoning board to permit the substitution of a preexisting nonconforming use.
  • Represented city clients in tort claims brought by property owners against city clients alleging property damage caused by flooding.
  • Represented city client in wrongful termination claim brought by former employee who was convicted of criminal offenses and sentenced to prison.

  • Represented city client in Section 1983 civil rights case brought by defendant alleging civil rights violations arising from his arrest and detention at the police station.

  • Argued on summary judgment before common pleas court that sewer district regulations imposed upon municipal client regarding storm water management were invalid.

  • Represented village in declaratory judgment and injunction action brought in common pleas court to declare property a public nuisance and for its abatement by demolition.
  • Represented city client in evidentiary hearings before city nuisance abatement board seeking to have property declared a public nuisance.
  • Represented city client and building inspector before board of zoning and building appeals regarding appeal of inspector's violation notice.
  • Represented city client in code enforcement case, including demolitions, handled through local administrative process.

  • Served as traffic prosecutor for village mayor's court, including handling trials of contested cases before magistrate.
