Overview

Walter | Haverfield attorneys are well-versed in federal and state employment law, workers’ compensation, union issues and ERISA. Our labor and employment attorneys collaborate with our public law, education law and litigation attorneys to provide our clients legal counsel that is relative to their workplace, providing expert guidance in the areas of:

  • Employment law, delivering counsel to employers on Title VII, ADA, ADEA, FMLA, OSHA, FLSA, and WARN and state employment laws, and defending discrimination claims before the EEOC, OCRC, and the Department of Labor
  • Labor, counseling non-unionized and unionized clients and providing representation to employers in arbitration proceedings and in defense of claims before SERB and the NLRB
  • Worker’s compensation, representing both self-insured and state-funded insured clients and appearing on behalf of employers at the administrative level (OIC) and in courts of common pleas

Our team’s experience includes:

  • Defends, mediates, and negotiates to resolution discrimination, wage-hour, and retaliation claims in state and federal court.
  • Defends federal sexual harassment lawsuits against major national corporations.
  • Defends ERISA lawsuit alleging wrongful denial of severance benefits.
  • Representation of a municipal client before the Ninth District Court of Appeals in a workers’ compensation matter involving the death of a police officer.
  • Representation of a client before the Ohio Supreme Court on the issue of workers’ compensation retaliation.
  • Prevailed at arbitration when a former employee challenged the employer’s decision to terminate the employee for poor performance.
  • Assisted in interest-based arbitration on behalf of a Cleveland suburb against a labor union that resulted in a favorable ruling and a cost-avoidance to the city of approximately $650,000 in wage premiums and insurance expenses.
  • Guides clients through strikes, plant closures, downsizing, facilities consolidation and relocation.
  • Leads clients through the decertification process.
  • Leads clients through union organization attempts.
  • Counsels employers in the Greater Cleveland area on union avoidance, union election campaign strategy, and strike avoidance   Conducted in-service training on policies and practices, including anti-harassment and public records policies.
  • Drafts and assists clients with WARN Act notifications and obligations.
  • Obtained jury verdict in favor of employer in FMLA and ADA lawsuit.
  • Drafts, enforces, and defends confidentiality, non-compete and non-solicitation agreements.
  • Develops personnel policies.
  • Assists employer clients in interpretation, application, and administration of collective bargaining agreements.
  • Defends employers in litigation and before the Equal Employment Opportunity Commission, the Ohio Civil Rights Commission, and the State Employment Relations Board.
