General Counsel Services - Education

Overview

Walter | Haverfield’s Education Law attorneys routinely serve as general counsel to school districts. In this role, we we are ideally positioned as a “one-stop shop” for the legal issues that face school districts. This experience allows us to identify risk in the general operations of the district, not just on the education front. After identifying an operational issue, we then are able to utilize the breadth and depth of our Firm resources in a wide variety of non-education areas, such as real estate, zoning and property matters, environmental issues, taxation, healthcare and other areas that may impact the district’s business operations. Given our Firm’s full-service resources, we are able to meet the needs of our school district clients – in all facets of their operations – in an efficient, cost-effective manner.

Experience

The "General Counsel Services - Education" group’s experience and services include the following:

  • Assists school districts with policy review and development.
  • Reviews contracts on behalf of school districts and negotiates vendor contracts on behalf of school districts.
  • Representation of school districts in mediations involving contractual claims.
  • Assists school districts with investigations by various agencies including the Ohio Auditor’s Office, Disability Rights Ohio and U.S. Department of Justice.
  • Adviss school districts of obligations under Ohio’s competitive bidding laws.
  • Counsels school districts in developing policies for compliance with the Ohio Teacher Evaluation System.
  • Representation of boards of education before county boards of revision and the Ohio Board of Tax Appeals to maintain the tax base of the school districts.
  • Advises clients on outsourcing and private contractor issues, including drafting Requests for Proposal and consulting contracting.
  • Advises boards of education and district administrators on union and non-union personnel issues, such as hiring, firing, evaluation, and pre-disciplinary hearings.
  • Defends Boards in civil litigation, administrative appeals, and before administrative agencies such as the Equal Employment Opportunity Commission, the Ohio Civil Rights Commission, and the State Employment Relations Board.
