Overview

Brendan joined Walter | Haverfield LLP as an associate in 2016 and is a member of the firm’s Public Law practice group. He has extensive experience representing public entities throughout Ohio, including cities, villages, townships and government agencies. He has advised various municipal boards and commissions, including boards of zoning appeals, planning commissions, and civil service commissions. Additionally, he served as an assistant director of law for the city of Cleveland Heights, Ohio.

Brendan’s litigation experience includes trial and appellate practice in the areas of land use and zoning; civil rights; public records and open meetings; employment; insurance defense; and contract law. Brendan has also argued cases before the Ohio Supreme Court, the Sixth Circuit Court of Appeals and various appellate courts throughout Ohio.

Experience

Public Law and Related Litigation
  • Represented municipalities in zoning hearings and related litigation;
  • Represented public officials and police officers in Section 1983 litigation, including First Amendment, excessive force, and procedural and substantive due process claims;
  • Served as assistant director of law for the city of Cleveland Heights;
  • Assisted in the prosecution of criminal violations; and
  • Obtained temporary restraining orders and injunctive relief on behalf of municipalities in nuisance abatement actions.
Land Use and Regulation
  • Represented municipal and township boards of zoning appeals and planning commissions;
  • Represented municipalities and townships in appeals to the common pleas and appellate courts;
  • Advised clients on zoning laws and regulations; and
  • Drafted and updated zoning codes/resolutions for multiple political subdivisions.
Litigation
  • Represents private and public sector clients in all phases of litigation;
  • Defended political subdivisions in Section 1983, employment and wrongful discharge, land use and zoning, and tort litigation;
  • Represented private sector clients in civil rights, tort, False Claims/Qui Tam, and employment and wrongful discharge litigation; and
  • Represented clients in mediation and negotiated settlements in civil rights, employment, contract, zoning and tort litigation.
Labor and Employment Services
  • Represented clients in claims brought under the Family Medical Leave Act, Age Discrimination in Employment Act, Americans with Disabilities Act, and various state statutes;
  • Represented clients in whistleblower actions, wrongful discharge, and discrimination claims; and
  • Advised public and private sector clients on state and federal employment laws and regulations.
