Overview

Patrick is an associate in Walter | Haverfield’s Corporate Transactions group. His practice also expands into the Litigation Services group. Patrick’s experience includes representing banks and other commercial lenders, commercial property owners, creditors and debtors in the U.S. Bankruptcy Court, and bankruptcy trustees, among others.

Patrick began his legal career as a law clerk to the Honorable Marilyn Shea-Stonum in the U.S. Bankruptcy Court, Northern District of Ohio. Prior to joining Walter | Haverfield, Patrick spent several years with a bankruptcy and commercial litigation boutique firm, where he served as lead counsel on more than 150 adversary proceedings in the U.S. Bankruptcy Court.

Patrick is a member of the Ohio, Florida and Cleveland Metropolitan Bar Associations.

Corporate Transactions

Creditors’ Rights & Bankruptcy
  • Represented debtors, creditors and bankruptcy trustees in Chapter 7 and Chapter 11 cases in the U.S. Bankruptcy Court.
  • Successfully represented debtor against trustee’s fraudulent transfer claim.
  • Represented debtors against bankruptcy trustee’s claim that certain obligations constituted a domestic support obligation.
  • Represented bankruptcy trustee in the probate court sale of a structured settlement.

Litigation Services

Appellate Litigation
  • Represented property owner in successful appeal relating to the defense of invalid mechanic’s lien claims asserted by a supplier who supplied materials to a tenant of the property.
  • Represented borrower in appellate action relating to a court’s ability to modify its judgments under Civ. R. 60(A) when no clerical error existed.
  • Represented bankruptcy trustee action in appeal involving subject matter jurisdiction of the bankruptcy court.
Commercial Litigation
  • Represented label manufacturer in breach of implied warranty of merchantability case.
  • Successfully represented debtor in a challenge to the appointment of a receiver over debtor’s real property.
Creditors' Rights Litigation
  • Represented bankruptcy trustees in numerous actions to recover preferential and fraudulent transfers of estate property.
  • Obtained judgment in favor of bankruptcy trustee that third party held property of the bankruptcy estate in a constructive trust for the benefit of the estate.
  • Reached substantial settlement in an action to recover a fraudulently transferred apartment located in St. Petersburg, Russian Federation.
  • Defeated creditor’s erroneously released lien under the Ohio Certificate of Title Act, resulting in the recovery of a Harley Davidson for administration by the bankruptcy trustee.
  • Represents creditors in obtaining and executing upon cognovit judgments.
  • Assisted creditor in reaching settlement that resulted in a 100% recovery of his claim in a substantial breach of contract suit.
  • Obtained motion to dismiss on behalf of bankruptcy trustee against government entity on the basis that the entity sought an advisory opinion.
  • Defeated turnover motion filed by bankruptcy trustee against non-debtor entity on the basis of procedural defects.
  • Recovered non-exempt bonus for bankruptcy trustee in a contested manner over the objections of debtor.
  • Represented bankruptcy trustee clients on obtaining judgments and executing on those judgments through wage garnishments, bank attachments, judgment liens, among other remedies.
Real Estate Litigation
  • Represented property owner in successful defense of invalid mechanic’s lien claims asserted by a supplier who supplied materials to a tenant of the property.
  • Obtained summary judgment in commercial foreclosure case on behalf of lender against third-party entity asserting invalid right of first refusal and various other challenges to foreclosure complaint, and successfully defeated that entity’s objection to the magistrate’s decision in favor of lender.
  • Represented bankruptcy trustees in defective mortgage claims against mortgagees and title companies.
Real Estate Services
  • Assisted residential real estate investor with the preparation of documents necessary to transfer and finance residential properties.
  • Represented bankruptcy trustees in the negotiation and sale of several properties, including working with title companies and drafting necessary sales documents and deeds.
